Thanks for visiting Gearflow, an innovative marketplace for construction equipment parts which is brought to you by Gearflow Inc. (hereinafter, "Gearflow," "we," "us," or "our"). This is the privacy policy ("Policy") that details how we handle and maintain the information collected from you in connection with the use of: (i) the website gearflow.com, and any other website that we operate (each, together with its subdomains, content and services, the "Site"); and (ii) through the managed relationships necessary for the provision of any of our merchandise and services (each, a "Service"). Hereinafter, the Site and any Service are individually and collectively referred to as the "Services."

Use of our Services is governed by our Terms and Conditions. This Policy describes our disclosure policies, as well as the choices that you have regarding use, access, and correction of your information. This Policy does not describe information collection policies and practices of websites and platforms that we do not provide, including those linked to or integrated with our Site(s). It also does not cover information you may choose to share with other users of the Site.

Information We Collect

Information You Provide. When you visit our Site we collect personally identifiable information about you which you affirmatively choose to submit to us, such as your name, e-mail address, telephone number, job title, mailing address, shipping addresses, equipment fleet, etc. From time to time we may also automatically collect certain information that may be considered personally identifiable information, such as the IP address of your computer or network connection. In order to fully use our Services, you are required to create an account (“Account”). Setting up an Account requires your name, email address and a password. If you provide any additional information, such as in your communications with us, doing so is entirely your choice, but be aware that we will retain the personal information that you choose to provide in those instances.

As applicable, we may record and maintain a historical record of your purchase history.

Payment Processing Information. When you make a payment in connection with the Services, Gearflow may obtain your credit card and/or other payment information.

Usage Information. We may collect other non-personally identifiable information such as the time and date of your visit, your location, the pages and other content that you access, and the number of times you return to the Site. This information is used in the aggregate for our internal marketing and similar purposes. We collect this information using technologies such as:

Cookies and Log Files: A cookie is a small data file which resides on your computer, and which allows us to recognize you as a user when you return using the same device or web browser. Cookie data is used to customize your experience when you use our Services. You can configure your web browser to warn you each time a cookie is being sent or to refuse cookies completely; however, if you opt not to accept cookies from us you may not be able to take full advantage of all of the features on our Site.

Embedded Script is programming code that collects information about your interactions with our Site, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider and is deactivated or deleted when you disconnect from our Site.

In addition, we may also integrate into certain technology provided by third parties (e.g., Google Analytics) to accomplish this information collection. We may likewise use a variety of other technologies that collect similar information for security and fraud detection purposes.

How We Use Information We Collect

We use your information primarily to provide our Services, including, but not limited to, helping us respond to inquiries, provide customer service, and send administrative information. We have no liability for disclosure of any information due to errors or the unauthorized acts of third parties during transmission or interaction with a website other than Gearflow’s.

We also use the information that we collect to improve our Site. We review information to learn about how our Site is used and accessed, and to analyze user behavior as a measure of interest in and use of our Site. We may disclose such analyses to advertisers or other third parties in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user. We may also use certain subsets of the same information to investigate and prosecute potential breaches of the Gearflow security or license agreements. We also may share pertinent personal information with select affiliates and partners for the purposes of processing data for marketing, research, analytics, customer support and account management.

We do not sell, trade, share, or rent your personal information provided by you to us through our Site(s) to third parties. Gearflow will only use your payment processing information with your explicit consent.

We may disclose information about you to third parties if we have a good-faith belief that we are required to do so by law or legal process, to respond to legal claims, or to protect our rights, property, or safety, or the rights, property, or safety of others. We may disclose information about you to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale or disposition of all or a portion our assets. The successor organization’s use and disclosure of your personal information will continue to be subject to this policy unless (i) a court orders otherwise, for example a bankruptcy court; or (ii) the successor organization gives you notice that your personal information will be subject to the successor organization’s own policy, along with an opportunity for you to opt out (which may cause you not to be able to continue to use the Site). If you submit personal information after such a transfer, that information may be subject to the successor entity’s policy.

Do Not Track

We do not track users over time and across third party websites to provide targeted advertising and therefore do not respond to “do not track” signals. Third parties that have content embedded within the service such as a social feature may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited a specific location from a certain IP address. Third parties cannot collect any other personally identifiable information from the service unless you provide it to them directly.

Social Features of the Gearflow Site

If you provide information in any social feature of our Site(s) (including, by way of example, via chat feature or online discussion forum), or to any other party through the Site, you should be aware that your information may then be made available to others.

Your Choices and Accuracy of Your Information

You always have the choice whether or not to provide any information to Gearflow. As indicated above, some of our Services require that you register an Account but doing so is at your discretion. If you choose not to provide required personal information, you can still use any portion of our Services that do not require it.

You can use the tools that we make available through our Services to modify or remove certain information related to your Account. Our Services may contain links to or otherwise allow you to interact with, certain third-party websites, mobile software applications and services that are not owned or controlled by Gearflow (each a "Third Party Service"). We are not responsible for the privacy practices or the content of any Third Party Service, and we encourage you to read the terms and conditions and privacy policy of any such Third Party Service that you choose to use.

Information Security

Gearflow takes commercially reasonable security and backup measures to protect the information submitted to us. However, no method of transmission over the internet, or method of electronic security, is 100% secure. Therefore, while we strive to protect your information, we cannot guarantee its absolute security. We encourage our customers and partners to retain copies of all uploaded information on their own systems.

Children’s Privacy

We do not knowingly collect any personal information from children under 13 years of age without parental consent. If we learn that a child under the age of 13 has provided us with personal information, or that such personal information has otherwise been inadvertently collected, we will delete it in accordance with applicable law.

California Privacy

California residents have additional rights regarding our use of your personal information and are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.

Gearflow is operated in the United States. If you are located outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Gearflow Services, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

Changes to this Privacy Policy

We may update this Policy at any time and any changes will be effective upon posting. In the event that there are material changes to the way we treat your personal information, we will display a notice on the Site, or through other means. Continued use of the Site(s) or our Services after any update will constitute your agreement to the new policy.
